I. Definitions

 

The terms used in the Regulations mean:

 

  1. Client – natural persons with full legal capacity, and in cases provided for by generally applicable regulations, also a natural person with limited legal capacity; legal entities; or organizational units without legal personality, which are granted legal capacity by law; - who has concluded or intends to conclude a Sales Agreement with the Seller.

 

  1. Civil Code - Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);

 

  1. Regulations - these Regulations for the provision of electronic services within the online store available on the websites: www.pwsam.eu , www.pwsam.com , www.pwsam.pl .

 

  1. Online store (Store) - online service available on the websites: www.pwsam.eu , www.pwsam.com , www.pwsam.pl., through which the Customer may, in particular, place Orders;

 

  1. Goods – products presented in the Online Store;

 

  1. Sales contract - a contract for the sale of Goods within the meaning of the Civil Code, concluded between Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o. and the Customer, concluded using the Store's website;

 

  1. Consumer Rights Act - Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827);

 

  1. Act on the provision of services by electronic means - Act of July 18, 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);

 

  1. Order - the Customer's declaration of will, aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of the Goods.

 

II. General provisions

 

  1. These Regulations define the rules for using the online store available at www.pwsam.pl , www.pwsam.eu and www.pwsam.com .

 

  1. These Regulations are the regulations referred to in Art. 8 of the Act on the provision of electronic services.

 

  1. Online store of Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o., located at:

  1. These Regulations specify in particular:

- rules for registering and using the account in the online store;

- terms and conditions for placing Orders electronically in the online store;

- rules for concluding Sales Agreements using the services provided within the Online Store.

 

  1. If you wish to use the online store, the Customer should obtain access to a computer, mobile or other device with Internet access on their own. Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o. is not responsible for incorrect display of the website on the device.
  2. In accordance with applicable legal provisions, Orders may be placed by: natural persons with full legal capacity, and in cases provided for by generally applicable provisions, also by natural persons with limited legal capacity; legal entities; or organizational units without legal personality, which are granted legal capacity by law; - who has concluded or intends to conclude a Sales Agreement with the Seller. In accordance with applicable law, Przedsiębiorstwo Wielobranżowe "SAM" reserves the right to limit the provision of services via the Online Store to persons who are over 18 years of age. In such a case, potential customers will be notified about the above.
  3. Customers can access these Regulations at any time via the link on the home page of the website www.pwsam.eu and www.pwsam.pl , download it and print it out.

 

III. Rules for using the Online Store

 

  1. Registration in the Online Store is optional. The Customer may place an order without registering in the Store, after reading and accepting these Regulations.

Registration takes place by completing and accepting the registration form available on one of the Store's pages

The condition for registration is to agree to the content of the Regulations and to provide personal data marked as mandatory.

Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o. may deprive the Customer of the right to use the Online Store, and may also limit his access to part or all of the resources of the Online Store, with immediate effect, in the event of a breach of the Regulations by the Customer, and in particular when the Customer:

- during registration in the online store, provided data that is untrue, inaccurate or outdated, misleading or violating the rights of third parties,

- has infringed the personal rights of third parties via the online store, in particular the personal rights of other customers of the online store,

- commits other behavior that will be considered by Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o. as behavior inconsistent with applicable law or general principles of using the Internet or detrimental to the good name of Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o.

 

  1. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.

 

  1. The customer is obliged in particular to:

not providing or transmitting content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,

use the Online Store in a way that does not interfere with its functioning, in particular through the use of specific software or devices,

not to take actions such as: sending or posting unsolicited commercial information in the Online Store (spam),

use the Online Store in a way that is not inconvenient for other customers and Przedsiębiorstwo Wielobranżowegp "SAM" sp. z o. o.,

use all content posted in the Online Store only for your own personal use,

use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.

 

IV. Procedure for concluding a Sales Agreement

  1. In order to conclude a Sales Agreement via the Online Store, please visit the website www.pwsam.eu , www.pwsm.com or www.pwsam.pl , make your selection and take further technical steps based on the messages displayed to the Customer and the information available on the website. .

 

  1. The Customer selects the Goods ordered by adding them to the cart.

 

  1. When placing an Order - until the button confirming the submission of the Order is pressed - the Customer has the opportunity to modify the entered data and the selection of the Goods. For this purpose, please follow the messages displayed to the Customer and the information available on the website.

 

  1. After the Customer using the Online Store provides all necessary data, a summary of the placed Order will be displayed. A summary of the placed Order will include, among others: a description of the selected goods or services, the total price and all other costs.

 

  1. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the button confirming the submission of the Order.

 

  1. Information about the Goods provided on the Store's website constitutes an offer within the meaning of Art. 66 of the Civil Code. Sending the Order by the Customer constitutes a declaration of will to conclude a Sales Agreement with Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o., in accordance with the Regulations.
    The contract is considered concluded when the Customer's Order is entered into the Online Store's IT system, provided that the Order complies with the Regulations. After concluding the contract, the Customer receives an e-mail containing confirmation of all important elements of the Order.

 

  1. The sales contract is concluded in Polish, with content consistent with the Regulations.

 

  1. Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o. reserves the right to cancel the customer's order in the event of a pricing error or unavailability of a given product.

 

VIII. Complaints regarding the Goods

 

  1. Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o. as a seller is liable to the Customer who is a consumer within the meaning of Art. 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular in Art. 556 and art. 556[1]-556[3] of the Civil Code.

 

  1. Complaints arising from the violation of the Customer's rights guaranteed by law or under these Regulations should be sent to the following address: Przedsiębiorstwo Wielobranżowe "SAM" sp. z oo 83-110 Tczew, ul. Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o. undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.

Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o. is the manufacturer of selected Goods available in the Store. In relation to these Goods, Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o., as the manufacturer, is liable for the warranty of the sold Goods on the terms and for the period indicated in the warranty card. In relation to Goods whose manufacturer is not Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o., the manufacturer may be independently liable under the warranty of the sold Goods under the conditions and for the period indicated in the warranty card issued by the manufacturer. If the manufacturer's warranty document provides for such a possibility, the Customer may submit his claims under the warranty directly to the authorized service center whose address is included in the warranty card.

 

IX. Complaints regarding the provision of electronic services

 

  1. Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o. takes steps to ensure the fully correct operation of the Store, to the extent resulting from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.

 

  1. The Customer is obliged to immediately notify Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o. about any irregularities or interruptions in the operation of the Online Store website.

 

  1. The Customer may report irregularities related to the operation of the Store in writing or electronically to the following address: Przedsiębiorstwo Wielobranżowe "SAM" sp. z o. o. 83-110 Tczew, ul.Borchardta 13, Poland, e-mail: kontakt@pwsam.pl, telephone number 6062311724. In the complaint The Customer should provide his name and surname, correspondence address, type and date of occurrence of any irregularity related to the operation of the Store.
  2. Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o. undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.

X. Final provisions

  1. Resolving any disputes arising between Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o. and the Customer who is a consumer within the meaning of Art. 22[1] of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.

 

  1. Resolving any disputes arising between Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o. and a Customer who is not a consumer within the meaning of Art. 22[1] of the Civil Code of the Civil Code, is subject to the court having jurisdiction over the registered office of Przedsiębiorstwo Wielobranżowe "SAM" sp z o. o.

 

  1. In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of electronic services and other relevant provisions of Polish law shall apply.
  2. The consumer may use out-of-court methods of dealing with complaints and pursuing claims. In order to take advantage of the possibility of amicable resolution of disputes regarding online purchases, the Consumer may submit a complaint, e.g. via the EU ODR online platform, available at:  http://ec.europa.eu/consumers/odr/
